1) Scope & Acceptance
By accessing or using DBM Learning Academy at dbmlearningacademy.com you agree to these Terms and any policies linked here (Privacy Policy, Code of Conduct, Homeschool Agreement, Refunds & Billing). If you don’t agree, do not use the Service.
Mokwe Enterprise LLC provides organizational tools, community areas, and content libraries; we are not providing legal advice, and we are not the school of record for your family unless expressly contracted in writing.
2) Eligibility & Accounts
- Users must be 18+ or have verified parental consent. Parents are responsible for student accounts and activity.
- Keep credentials confidential. You are responsible for activity under your account.
- We may refuse, suspend, or terminate accounts for violations or risk.
3) The Service
The Service includes: (a) planning tools (curriculum, attendance, portfolio), (b) a Library & Resource Center where content may be shared universally across the platform, and (c) collaboration features (parents, students, teachers/coaches, principal guides).
We may change features, impose limits, or discontinue parts of the Service with reasonable notice where practicable.
4) Library & Resource Center (“Shared & Universal”)
Content uploaded or contributed to the Library/Resource Center is viewable by other users platform-wide unless a page explicitly states otherwise. Because it is shared and universal, you must:
- Post only content you have rights to share (no pirated textbooks, paywalled content, or private materials without permission).
- Remove or update content when rights change or errors are discovered.
- Exclude personal data about minors or any sensitive information (addresses, medical data, etc.).
- Follow Code of Conduct content rules.
We reserve the right to curate, rearrange, annotate, or remove Library entries for quality, legality, and safety.
5) User Content, License & Contributor Warranties
Your Ownership You retain ownership of your content. You grant Mokwe Enterprise LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, perform, adapt (formatting/transcoding), and distribute your content solely to operate, improve, and provide the Service, including the “shared & universal” Library and Resource Center.
Visibility to Others By contributing to the Library, you grant all signed-in users a personal, non-transferable license to access and use the content for educational purposes within the platform. Redistribution outside the platform is prohibited unless the content is clearly marked with an explicit open license (e.g., a CC license you selected).
Warranties You warrant that you have all rights to grant the above licenses, your content does not infringe third-party rights, and that it complies with these Terms and the Code of Conduct.
Feedback If you send suggestions or improvements, you grant us a license to use them without obligation.
6) Prohibited Content & Uses
- Illegal, infringing, defamatory, harassing, hateful, or pornographic material; sexual content involving minors; explicit violence or gore.
- Private or sensitive data about others (especially students/minors).
- Spam, scams, malware, scraping, or attempts to bypass security.
- Any content that violates educational integrity (plagiarism, cheating aids) or exam security.
- Commercial advertising in Library posts unless expressly permitted.
7) Moderation, Takedown & Strikes
We may remove content or restrict accounts to protect users and comply with law. We operate a typical three-strike policy for non-egregious violations; egregious violations (e.g., child safety, piracy at scale) may trigger immediate suspension or termination. You may appeal removals by emailing support@dbmlearningacademy.com with context and links.
We may preserve data to meet legal obligations or investigate violations.
8) IP Complaints / DMCA
If you believe content infringes your copyright or trademark, email support@dbmlearningacademy.com with: (a) identification of the work and the specific URL(s), (b) your contact info, (c) a statement under penalty of perjury that you are authorized, and (d) your signature. We may notify the uploader and provide an opportunity to counter-notice per applicable law.
9) Privacy & Student Data
See our Privacy Policy. Parents control student use. We do not sell student personal information. Advertising aimed at minors is prohibited on the Service.
10) Billing, Subscriptions & Refunds
Some features are paid. By starting a subscription, you authorize recurring charges until you cancel. Refund rules are set in Refunds & Billing. Taxes may apply. Chargebacks may result in immediate suspension.
11) School / Homeschool-Specific
- Parents are responsible for meeting local homeschool requirements. Our compliance pages are informational, not legal advice.
- Coach/teacher roles are collaborative and do not replace parental responsibility unless a separate written contract states otherwise.

12) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. CONTENT MAY BE USER-GENERATED; WE DO NOT ENDORSE OR GUARANTEE ITS ACCURACY.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Mokwe Enterprise LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
14) Indemnification
You will indemnify and hold harmless Mokwe Enterprise LLC from claims arising out of your content, your use of the Service, or your violation of these Terms or law.
15) Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflicts rules. Disputes will be resolved in state or federal courts located in Maricopa County, Arizona, unless otherwise required by law. You consent to personal jurisdiction there. Where permitted, disputes must be brought in your and our individual capacity (no class actions).
16) Changes to These Terms
We may update these Terms. Material changes will be notified by email or in-product notice. Continued use after the effective date constitutes acceptance.
